AnordinanceaddingArticle5.1toChapter IV oftheLosAngelesMunicipalCode 

andamendingSection91.107.3.2oftheLosAngelesMunicipalCodetoimplementthe 

CompassionateUseActandtheMedicalMarijuanaProgramActconsistentwiththe 

provisionsoftheActs,butwithoutviolatingstateorfederallaw. 

WHEREAS, althoughthepossessionandsaleofmarijuanaremainillegalunder 

bothstateandfederallaw,CaliforniavotersapprovedtheCompassionateUseAct 

("CUA")in1996toexemptseriouslyillpatientsandtheirprimarycaregiversfrom 

criminalliabilityforpossessionandcultivationofmarijuanaformedicalpurposes;and 

. 

WHEREAS, theMedicalMarijuanaProgramActof2003("MMPA")providesfor 

theassociationofprimarycaregiversandqualifiedpatientstocultivatemarijuanafor 

specifiedmedicalpurposesandalsoauthorizeslocalgoverningbodiestoadoptand 

enforcelawsconsistentwithitsprovisions;and 

WHEREAS, theCityofLosAngelesenactedanInterimControlOrdinancein 

2007forthetemporaryregulationofmedicalmarijuanafacilitiesthrougharegistration 

program,whichresultedintheunintendedproliferationofstorefrontmedicalmarijuana 

dispensariestoanumbercurrentlyestimatedtoexceed500suchlocations,presenting 

aSUbstantialriskofunlawfulcultivation,sale,andtheillegaldiversionofmarijuanafor 

non-medicaluses;and 

WHEREAS, therehavebeenrecentreportsfromtheLosAngelesPolice 

Departmentandthemediaofanincreaseinandescalationofviolentcrimeatthe 

locationofmedicalmarijuanadispensariesintheCityofLosAngeles,andtheCalifornia 

PoliceChiefsAssociationhascompiledanextensivereportdetailingthenegative 

secondaryeffectsassociatedwithmedicalmarijuanadispensaries;and 

WHEREAS, medicalmarijuanathathasnotbeencollectivelyorpersonallygrown 

constitutesauniquehealthhazardtothepublicbecause,unlikeallotheringestibles, 

marijuanaisnotregulated,inspected,oranalyzedforcontaminationbystateorfederal 

governmentandmay,aswithsamplesrecentlytestedbyaU.S.FoodandDrug 

Administrationlaboratory,containharmfulchemicalsthatcouldfurtherendangerthe 

healthofpersonswhoarealreadyseriouslyillandhaveimpairedorreduced 

immunities;and 

WHEREAS, theCityofLosAngeleshasacompellinginterestinensuringthat 

marijuanaisnotdistributedinanillicitmanner,inprotectingthepublichealth,safetyand 

welfareofitsresidentsandbusinesses,inpreservingthepeaceandquietofthe 

neighborhoodsinwhichmedicalmarijuanacollectivesoperate,andinproviding 

compassionateaccesstomedicalmarijuanatoitsseriouslyillresidents.

NOW,THEREFORE, 

THEPEOPLEOFTHECITYOFLOSANGELES 

DOORDAINASFOLLOWS: 

Section1.AnewArticle5.1isaddedtoChapterIVoftheLosAngelesMunicipal 

Codetoread: 

ARTICLE5.1 

MEDICALMARIJUANACOLLECTIVE 

SEC.45.19.6.PURPOSESANDINTENT. 

Itisthepurposeandintentofthisarticletoregulatethecollectivecultivationof 

medicalmarijuanainordertoensurethehealth,safetyandwelfareoftheresidentsof 

theCityofLosAngeles.Theregulationsinthisarticle,incompliancewiththe 

CompassionateUseAct,theMedicalMarijuanaProgramAct,andtheCaliforniaHealth 

andSafetyCode(collectivelyreferredtoas"StateLaw")donotinterferewithapatient's 

righttousemedicalmarijuanaasauthorizedunderStateLaw,nordotheycriminalize 

thepossessionorcultivationofmedicalmarijuanabyspecificallydefinedclassifications 

ofpersons,asauthorizedunderStateLaw.UnderStateLaw,onlyqualifiedpatients, 

personswithidentificationcards,andprimarycaregiversmaycultivatemedical 

marijuanacollectively.Medicalmarijuanacollectivesshallcomplywithallprovisionsof 

theLosAngelesMunicipalCode("Code"),StateLaw,andallotherapplicablelocaland 

statelaws.Nothinginthisarticlepurportstopermitactivitiesthatareotherwiseillegal 

understateorlocallaw. 

SEC.45.19.6.1.DEFINITIONS. 

A.Thefollowingphrases,whenusedinthisarticle,shallbeconstruedas 

definedinCaliforniaHealthandSafetyCodeSections11006.5,11018,11362.5and 

11362.7: 

"Attendingphysician;" 

"ConcentratedCannabis;" 

"Identificationcard;" 

"Marijuana;" 

"Personwithanidentificationcard;" 

"Primarycaregiver;"and 

"Qualifiedpatient." 

B.Thefollowingphrases,whenusedinthisarticle,shallbeconstruedas 

definedbelow.Wordsandphrasesnotdefinedhereshallbeconstruedasdefinedin 

Sections11.01,12.03,45.19.5,45.21,and56.45ofthisCode.

"Location."Thelotorportionofalotthatisusedbyamedicalmarijuana 

collective. 

"Medicalmarijuana."Marijuanausedformedicalpurposesin 

accordancewithCaliforniaHealthandSafetyCodeSection11362.5 

"Medicalmarijuanacollective("collective")."Anincorporatedor 

unincorporatedassociation,composedsolelyoffourormorequalifiedpatients, 

personswithidentificationcards,anddesignatedprimarycaregiversofqualified 

patientsandpersonswithidentificationcards(collectivelyreferredtoas 

"members")whoassociateataparticularlocationtocollectivelyorcooperatively 

cultivatemarijuanaformedicalpurposes,instrictaccordancewithCalifornia 

HealthandSafetyCodeSections11362.5, et seq.  

"Memberengagedinthemanagement."Amemberwithresponsibility 

fortheestablishment,organization,registration,supervision,oroversightofthe 

operationofacollective,includingbutnotlimitedtomemberswhoperformthe 

functionsofpresident,vicepresident,boardmember,director,owner,operating 

officer,financialofficer,secretary,treasurer,ormanagerofthecollective. 

"Privatemedicalrecord."Documentationofthemedicalhistoryofa 

qualifiedpatientorpersonwithanidentificationcard."Privatemedicalrecord" 

shallnotincludetherecommendationofanattendingphysicianordoctorforthe 

medicaluseofmarijuana,anidentificationcard,orthedesignationofaprimary 

caregiverbyaqualifiedpatientorbyapersonwithanidentificationcard. 

"Reasonablecompensation."Compensationcommensuratewith 

reasonablewagesandbenefitspaidtoemployeesofIRS-qualifiednon-profit 

organizationswhohavesimilarjobdescriptionsandduties,requiredlevelof 

educationandexperience,priorindividualearningshistory,andnumberofhours 

worked.Thepaymentofabonusshallnotbeconsidered"reasonable 

compensation." 

SEC.45.19.6.2.REGISTRATION. 

A.RegistrationRequired.Nocollectiveshalloperateuntilafterithasfileda 

registrationforminaccordancewiththeprovisionsofthisarticle,haspaidanyadopted 

registrationfees,anditsregistrationhasbeenacceptedascompletebytheDepartment 

ofBuildingandSafety. 

B.MaximumNumberofCollectives. 

1.ThemaximumnumberofcollectivesintheCityshallbecappedat70. 

However,theremaybefewerthan70collectivesifsufficientlocationsdonotexist 

consistentwithSection45.19.6.3A.2ofthisarticlefor70collectives.Tothefullest 

extentthatlocationsconsistentwithSection45.19.6.3A.2ofthisarticleexist,the

70 collectives shall be proportionally distributed by Community Plan Area, based  

on each Community Plan Area's percentage share of the City's total Community  

Plan Area population, as estimated by the Department of City Planning as of  

October 1,2008, as shown on Table 1, below:

2.Notwithstandingthemaximumnumberofcollectivesdescribedabove, 

everymedicalmarijuanacollective,dispensary,operator,establishment,orprovider 

that(1)wasregisteredpursuanttoInterimControlOrdinanceNo.179,027withthe 

CityClerk'sofficeonorbeforeNovember13,2007,(2)hasoperatedcontinuously 

atitsregisteredlocationsinceonorbeforeSeptember14,2007,orhasbothmoved 

oncewithintheCityduetoanenforcementletterfromafederalgovernmentalentity 

andfiledahardshipexemptionapplicationpursuanttoInterimControlOrdinance 

No.179,027,(3)hasthesameownershipandmanagementasitidentifiedinits 

registrationwiththeCityClerk'soffice,(4)hasnotbeencitedbytheCityfora 

nuisanceorpublicsafetyviolationofStateorlocallaw,and(5)compliescurrently 

oridentifiestotheCityduringthepreinspectionprocessanewoperatinglocation 

thatmeetsallofthedistancerequirementsofSection45.19.6.3A.2ofthisarticle 

maybeeligibletoregisterandoperateifitimmediatelycomplieswithallprovisions 

ofStateLaw,andwithin180daysaftertheeffectivedateofthisordinance 

completesitscomplianceinfullwitheachprovisionofthisarticle.Anycollectives 

allowedtoregisterandoperateinexcessof70shallalsobeproportionally 

distributedbyCommunityPlanArea,basedoneachCommunityPlanArea's 

percentageshareoftheCity'stotalCommunityPlanAreapopulation,as 

estimatedbytheDepartmentofCityPlanningasofOctober1,2008onTable1, 

above.IndeterminingthenumberofcollectivesallowedineachCommunity 

PlanArea,theDepartmentofCityPlanningshallapplythesepercentagestothe 

totalnumberofcollectivesthatfiletheirintenttoregisterwiththeCityClerk 

pursuanttoSubsectionC.1,below. 

3.ThetotalpopulationoftheCity,thepopulationoftheCommunityPlan 

Areas,andwhetherthecitywideandCommunityPlanAreacapsmeettheneeds 

ofqualifiedpatients,personswithidentificationcards,andtheirprimary 

caregiversmaybereviewedandthecapsmaybeamendedbyordinanceafter 

noticeandhearingbytheCityCouncil. 

C. Priority Order.  

1.AllcollectivesthatmeettherequirementssetforthinParagraph2of 

SubsectionB,above,andthatnotifytheCityClerkwithinoneweekafterthe 

effectivedateofthisordinanceoftheirintentiontoregisterunderthisarticleatan 

identifiedlocationshallbeeligibletoapplyforpreinspectionpursuanttoSubsection 

D,below.TheCityClerkshallusethedateandtimethatthesecollectives 

registeredwiththeCitypursuanttoInterimControlOrdinanceNo.179,027,as 

evidencedbythedateandtimestampplacedoneachregistrationformbythe 

CityClerk,todeterminethepriorityorderinwhichtheDepartmentofBuildingand 

Safetywillconductthepreinspectionsofthesecollectives. 

2.Ifatanytimeafter180daysfollowingtheeffectivedateofthisordinance, 

thetotalnumberofregisteredcollectivesintheCityfallsbelow70,theCityClerk 

mayholdoneormoredrawingsforthepurposeofdeterminingthepriorityorderin 

whichtheDepartmentofBuildingandSafetywillconsiderpreinspectlonofthese

additionalcollectives.AnycollectivethatnotifiestheCityClerkwithinoneweek 

afterthepublicationofthedateofaprioritydrawingshallbeeligibletoparticipatein 

thedrawings.However,nocollectivemayparticipateinadrawingifoneormore 

ofitsownersormembersengagedinitsmanagementwereconvictedcurrently 

orwithintheprevious10yearsofafelonyoracrimeofmoralturpitude,orare 

currentlyonparoleorprobationforthesaleordistributionofacontrolled 

substance. 

TheCityClerkshall:createtheentryformforparticipationinthedrawings; 

setthedeadlineforsubmittalofallentryforms;establishandpublishthe 

drawings'dates,times,andplaces;publishtheresultsofalldrawings;andhave 

theauthoritytopromulgateadditionaldrawingrulesandregulations.Allsuch 

rulesandregulationsshallbepublishedonceinadailynewspaperofgeneral 

circulationintheCity,andshalltakeeffectuponpublication.Amemberengaged 

inthemanagementofthecollectivemustbepresentatadrawinginorderforthe 

collectivetoparticipate. 

TheorderestablishedbytheCityClerkinthedrawingshallbeusedbythe 

DepartmentofBuildingandSafetytodeterminetheorderinwhichthe 

DepartmentofBuildingandSafetywillconductpreinspectionspursuantto 

SubsectionD,below,ofthecollectivesthatareeligibletoregisterpursuanttothis 

subdivision. 

D. Preinspection. Acollectivethatiseligibletoapplyforpreinspectionpursuant 

toSubsectionsBorC,above,maythereafterapplytotheDepartmentofBuildingand 

SafetyforpreinspectiontoverifycompliancewiththestandardssetforthinSection 

45.19.6.3Aofthisarticle.Thecollectiveshallprovidetheaddressoftheproposed 

collectivelocation;thename,telephonenumber,andaddressofapersonauthorizedto 

acceptserviceofprocessforthecollective;thename(s),telephonenumber(s),and 

address(es)ofeachmemberengagedinthemanagementofthecollective;anda 

1,DOD-footradiusmapsignedbyalicensedcivilengineer,architectorlandsurveyor,that 

locatesandidentifiesallsensitiveusessetforthinSection45.19.6.3A,2ofthisarticle. 

ApreinspectionfeepursuanttoSection91.107.3.2ofthisCode,plusaresearchfeefora 

minimumofthreehoursoftimepursuanttoSection98.0415 (f) ofthisCode,shallbepaid 

totheDepartmentofBuildingandSafetyatthetimeofarequestforpreinspection.The 

DepartmentofBuildingandSafetyshallproceedbypriorityorderwithineachCommunity 

PlanAreatoevaluatethecomplianceoftheproposedcollectiveswiththerequirements 

ofSection45.19.6.3Aofthisarticle.OncetheDepartmentofBuildingandSafetyhas 

determinedthatthemaximumnumberofcollectivesauthorizedbySubsectionBofthis 

sectioncomplies,theDepartmentofBuildingandSafetyshallstopdeterminingthe 

complianceofmorecollectives.Anycollectivenotincompliancewiththerequirements 

ofSection45.19.6.3Aofthisarticle,asdeterminedbytheDepartmentofBuildingand 

Safety,ornotconsideredforcompliancebecausethecaphadalreadybeenmet,shall 

benotifiedbytheDepartmentofBuildingandSafetythatitisdisqualifiedfromstarting 

thepreinspectionandregistrationprocessandthatitmayenteranyfuturedrawing 

conductedinaccordancewithSubsectionC,above.

E. Notice of Preinspection. Priortoacceptingarequestforpreinspection,the 

DepartmentofBuildingandSafetyshallrequireproofthatthecollectivehasprovided 

writtennoticetothePoliceDepartment,allpropertyownersandoccupantswithinand 

outsidetheCitythatarewithin1,000feetoftheexteriorboundariesofthelocation,and 

totheCityCouncilmemberofthedistrictinwhichthecollectiveisproposedtobe 

located,theCertifiedNeighborhoodCouncil,andanyBusinessImprovementDistrict 

("BID")representingtheareainwhichthecollectiveislocated,of:thepreinspection 

request;theproposedlocationofthecollective;thename,telephonenumber,and 

addressofapersonauthorizedtoacceptserviceofprocessforthecollective;the 

name(s),telephonenumber(s),andaddress(es)ofeachmemberengagedinthe 

managementofthecollective;andtheonsitetelephonenumberatthecollectiveandthe 

nameofthememberengagedinthemanagementofthecollectivewhoisresponsible 

forreceiving,logging,andrespondingtocomplaintsregardingthecollective.This 

notificationshallbesentbycertifiedmail,postageprepaid,andreturnreceipt 

requested.Noticestopropertyownersshallbesenttothelastknownnameand 

addressasshownontherecordsoftheCityClerkortherecordsoftheCounty 

Assessor;noticestooccupantsofallresidential,commercialandindustrialpropertycan 

bemailedto"occupant".Proofofmailingshallbeestablishedifthecollectivefilesan 

affidavitofmailingwiththeDepartmentofBuildingandSafetycertifyingthedateon 

whichthenoticewassent,acopyofthenotice,andacompletelistofthenamesand 

addresseswherethenoticewassent. 

F. Registration Form. UponreceiptofaDepartmentofBuildingandSafety 

preinspectionreportverifyingcompliancewiththestandardssetforthinSection 

45.19.6.3Aofthisarticle,thecollectiveshallfilearegistrationformwiththeDepartment 

ofBuildingandSafety.Theregistrationformshallrequirethefollowingaccurateand 

truthfulinformation:theaddressandphysicaldescription(e.g.,one-storycommercial 

building,etc.)oftheproposedlocationatanduponwhichthecollectivewillbelocated; 

thename,telephonenumber,andaddressofapersonauthorizedtoacceptserviceof 

processforthecollective;thename(s),telephonenumber(s),andaddress(es)ofeach 

memberengagedinthemanagementofthecollective;theonsitetelephonenumberat 

thecollectiveandthenameofthememberengagedinthemanagementofthe 

collectivewhoisresponsibleforreceiving,logging,andrespondingtocomplaints 

regardingthecollective;andanyotherinformationreasonablyrequiredtoshowthatthe 

collectivecomplieswiththisarticle.Inaddition,theregistrationformshallconfirmthe 

consentbythecollective,withoutrequirementforasearchwarrant,subpoenaorcourt 

order,fortheinspectionandcopyingbythePoliceDepartmentoftherecordingsand 

recordsrequiredtobemaintainedunderSections45.19.6.3,45.19.6.4,and45.19.6.5of 

thisarticle,exceptthatprivatemedicalrecordsshallbemadeavailablebythecollective 

tothePoliceDepartmentonlypursuanttoaproperlyexecutedsearchwarrant, 

subpoena,orcourtorder. 

Thecollectiveshallfileanupdatedregistrationformquarterly,butonlyifthere 

werechangesduringthepreviousquartertoanyoftheinformationprovidedintheinitial 

registrationformoranychangeinstatusofcompliancewiththeregulationssetforthin 

Section45.19.6.3ofthisarticle.Ifanenforcementactionhasbeenfiledagainstthe

collectiveforanyviolationofthisarticle,theupdatedregistrationformshallincludethe 

namesofallofthemembersofthecollective.Achangeoflocationcannotbe 

accomplishedbyanupdatedregistrationform,butshallinsteadrequireanew 

preinspectionandregistration.Eachandeverymemberwhoisengagedinthe 

managementofthecollectiveshallprinthisorhernameandsigntheinitialregistration 

formandanysubsequentupdatedregistrationform,underpenaltyofperjurycertifying 

thatallinformationcontainedintheregistrationformistrueandcorrect.Itshallbethe 

soleresponsibilityofthemembersengagedinthemanagementofthecollectiveto 

ensurethatallformsanddocumentsaresubmittedasrequiredbythisarticleandthat 

theinformationprovidedisaccurate,completeandtimelysubmitted. 

G.Additional Registration Documents.Asattachmentstotheoriginaland 

anysubsequentlyupdatedregistrationform,thecollectiveshallprovidetothe 

DepartmentofBuildingandSafety:(1)proofthatthepropertyownerofthelocation, 

andlandlordifapplicable,wasgivenwrittennoticesentbycertifiedmail,postage 

prepaid,andreturnreceiptrequestedthatthecollectiveintendstofiletheregistration 

formandthattheownerofthelocation,andlandlordifapplicable,hasreceivedacopy 

oftheinformationcontainedintheregistrationform;(2)foreachmemberengagedin 

themanagementofthecollective,afullylegiblecopyofonegovernment-issuedformof 

identification,suchasasocialsecuritycard,astatedriver'slicenseoridentification 

card,orapassport;and(3)thecollective'sCertificateofOccupancywithin10daysof 

issuance. 

H.RegistrationTimetables.Allcollectivesthatmeettherequirements 

describedinSubsectionB,above,shallcomplywiththefollowingtimetable:(1)they 

shallnotifytheCityClerkoftheirintenttoregisterunderthisarticlewithinoneweekafter 

theeffectivedateofthisordinance;(2)theyshallcompletetheirpreinspectionobligations 

underSubsectionsDandE,above,withinthirty(30)daysafterreceivingpriorityunder 

SubsectionC,above,toapplyforpreinspection;and(3)theyshallcomplyinfullwithall 

registrationandotherprovisionsofthisarticlewithin180daysaftertheeffectivedateof 

thisordinance.Allothercollectivesshallcomplywiththefollowingtimetable:(1)theyshall 

notifytheCityClerkoftheirintenttoregisterunderthisarticlewithinoneweekafterthe 

publicationbytheCityClerkofthedateofaprioritydrawingthatwillbeconducted 

becausethetotalnumberofregisteredcollectivesintheCityhasfallenbelow70;and(2) 

theyshallcompletetheirpreinspectionobligationsunderSubsectionsDandE,above, 

withinthirty(30)daysafterreceivingpriorityorderunderSubsectionC,above,toapplyfor 

preinspection;and(3)theyshallcomplyinfullwithallregistrationandotherprovisionsof 

thisarticlewithin180daysafterthepublicationbytheCityClerkofthedateofapriority 

drawingthatwillbeconductedbecausethetotalnumberofregisteredcollectivesinthe 

Cityhasfallenbelow70.Acollectivethatdoesnotcomplywithitsapplicabletimetable 

shallbedisqualifiedfromfurtherparticipationintheregistrationprocess. 

Forthepurposesofthissubsection,acollectiveshallbeincompliancewithSection 

45.19.6.3Aofthisarticleifithasobtainedallrequiredbuildingpermit(s)andthepermit(s) 

isvalidandhasnotbeenexpiredbytheDepartmentofBuildingandSafetypursuanttothe 

provisionsofSection98.0602oftheCode.NotwithstandingtheprovisionsofSection

12.26A.3oftheCode,thesubmissionofplanssufficientforacompleteplancheckand 

thepaymentofafeeshallnotconferavestedrighttoestablishacollective.The 

provisionsofSection91.106.4.3.1ofthisCodeshallapplytoanybuildingpermitissuedfor 

acollective. 

I. CompletedRegistration.TheDepartmentofBuildingandSafety,after 

verificationthatallrequiredfeeshavebeenpaid,shallmailproofofacompleted 

registrationandanysubsequentupdatedregistrationtothepersonauthorizedtoaccept 

serviceofprocessonbehalfofthecollective,totheownerofthelocation,theCity 

Councilmemberofthedistrictinwhichthecollectiveislocated,theCertified 

NeighborhoodCouncil,andtoanyapplicableBusinessImprovementDistrict("BID")in 

whichthecollectiveislocated. 

J. TermofRegistration/Renewal.Eachregistrationshallexpiretwoyearsfrom 

thedatetheDepartmentofBuildingandSafetymailsproofofthecompletedregistrationto 

thepersonauthorizedtoacceptserviceofprocessonbehalfofthecollectiveoruponthe 

sunsetofthisarticle,whicheveroccursfirst.Intheeventofanextensionofthesunsetof 

thisordinance,acollectivethathasoperatedatalltimesinstrictcompliancewiththis 

articlemayseektorenewitsregistration90dayspriortotheregistration'sexpiration.The 

processforrenewaloftheregistrationshallbethesameastheprocessfortheoriginal 

registrationassetforthinthissection.Uponregistrationexpiration,thecollectiveshall 

ceasealloperations. 

K.RegistrationNullandVoid.Aregistrationacceptedascompleteunderthis 

articleshallbecomenullandvoiduponthecessationofmarijuanacultivationatthe 

locationfor90daysorlonger,upontherelocationofthecollectivetoadifferentlocation, 

uponconvictionofthecollectiveoranyofitsmembersforaviolationofaprovisionofthis 

article,twoyearsaftertheissuanceoftheregistrationassetforthinSubsectionI,above, 

orupontheexpirationorsunsetofthisarticle. 

SEC.45.19.6.3.REGULATIONS. 

Thelocationatoruponwhichacollectivecultivatesandprovidesmedical 

marijuanatoitsmembersmustmeetthefollowingrequirements: 

A.PreinspectionRequirements. 

1.ThelocationshallcomplywiththeprovisionsofChapterIandIXofthe 

Code; 

2.Thelocationofthecollectiveshallcomplywiththefollowingdistance 

requirements: 

a.Nocollectiveshallbelocatedwithina1,ODD-footradiusofa 

school,publicpark,publiclibrary,religiousinstitution,licensedchildcare 

facility,youthcenter,substanceabuserehabilitationcenter,oranyother

medicalmarijuanacollective(s).Thedistancesspecifiedinthisparagraph 

shallbethehorizontaldistancemeasuredinastraightlinefromthe 

propertylineoftheschool,publicpark,publiclibrary,religiousinstitution, 

licensedchildcarefacility,youthcenter,substanceabuserehabilitation 

center,orothermedicalmarijuanacollective(s),totheclosestpropertyline 

ofthelotonwhichthecollectiveislocatedwithoutregardtointervening 

structures.Thisprovisionshallnotapplytoacollectivethatisalsoa 

licensedresidentialmedicaloreldercarefacility;and 

b.Nocollectiveshallbelocatedonalotabutting,acrossthestreet 

oralleyfrom,orhavingacommoncornerwitharesidentiallyzonedlotor 

alotimprovedwitharesidentialuse,includingamixeduseresidential 

building.Thisprovisionshallnotapplytoacollectivethatisalsoa 

licensedresidentialmedicaloreldercarefacility; 

3.Exteriorbuildinglightingandparkingarealightingforthelocationmust 

beincompliancewithSections93.0104,93.0107and93.0117oftheCode.In 

addition,thelocationshallbeequippedwithlightingfixturesofsufficientintensity 

toilluminateallinteriorareasofthelotwithanilluminationofnotlessthan1.5 

foot-candlesevenlydistributedasmeasuredatfloorlevel,exceptthatalicensed 

residentialmedicaloreldercarefacilityshallnotberequiredtocomplywiththis 

provision; 

4.Nointeriorilluminationofanyexteriorsignsoranyinteriorsignsvisible 

fromtheexteriorshallbeallowed; 

5.Windowsandroofhatchesofthebuildingorportionofthebuilding 

wherethecollectiveislocatedshallbesecuredfromtheinsidewithbarssoasto 

preventunauthorizedentry,andshallbeequippedwithlatchesthatmaybe 

releasedquicklyfromtheinsidetoallowexitintheeventofemergencyin 

compliancewithallapplicablebuildingcodeprovisions; 

6.Exteriordoorstothecollectiveshallremainlockedfromtheoutsideto 

preventunauthorizedingresstothepremisesofthecollective.Ingressshallbe 

allowedbymeansofaremotereleaseoperatedfromwithinthepremisesofthe 

collective.Inallcases,doorsshallremainopenablefromtheinsidetoallow 

egresswithouttheuseofakeyorspecialknowledge.Ifinstalled,access- 

controlledegressdoorsshallcomplywithSection1008.1.3.4oftheCalifornia 

BuildingCode; 

7.Asignshallbepostedinaconspicuouslocationinsidethestructureat 

thelocationadvising:"Thiscollectiveisregisteredinaccordancewiththelawsof 

theCityofLosAngeles.Thesaleofmarijuanaandthediversionofmarijuanafor 

non-medicalpurposesareviolationsofStatelaw.Theuseofmarijuanamay 

impairaperson'sabilitytodriveamotorvehicleoroperateheavymachinery.

Loiteringatthelocationofamedicalmarijuanacollectiveforanillegalpurposeis 

prohibitedbyCaliforniaPenalCodeSection647(h),,;and 

8.Asignshallbepostedattheentrancetothelocationcontainingthe 

nameandfunctioningtelephonenumberofa24-houron-callmemberengagedin 

themanagementofthecollectivewhoshallreceive,log,andrespondto 

complaintsandotherinquiresonbehalfofthecollective. 

B. Conditions of Operation.  

1.Thelocationshallbemonitoredatalltimesbyweb-basedclosed-circuit 

televisionforsecuritypurposes.Thecameraandrecordingsystemmustbeof 

adequatequality,colorrenditionandresolutiontoallowthereadyidentificationof 

anyindividualcommittingacrimeanywhereonoradjacenttothelocation.The 

recordingsshallbemaintainedforaperiodofnotlessthanninetydaysandshall 

bemadeavailablebythecollectivetothePoliceDepartmentuponrequest; 

2.Thelocationshallhaveacentrally-monitoredfireandburglaralarm 

systemandthebuildingortheportionofthebuildingwherethecollectiveis 

locatedshallcontainafire-proofsafe; 

3.Nocultivationofmedicalmarijuanaatthelocationshallbevisiblewith 

thenakedeyefromanypublicorotherprivateproperty,norshallcultivated 

marijuanaordriedmarijuanabevisiblefromthebuildingexterior.Nocultivation 

shalloccuratthelocationunlesstheareadevotedtothecultivationissecured 

frompublicaccessbymeansofalockedgateandanyothersecuritymeasures 

necessarytopreventunauthorizedentry; 

4.NomanufactureofconcentratedcannabisinviolationofCalifornia 

HealthandSafetyCodesection11379.6isallowed; 

5.Nocollectiveshallbeopenorprovidemedicalmarijuanatoits 

membersbetweenthehoursof8:00p.m.and10:00a.m.Thisprohibitionshall 

notapplytoaqualifiedpatient'suseofmarijuanaforhisorherownmedical 

needsifthequalifiedpatient'spermanentlegalresidenceisthelocation; 

6.Nocollectiveshalloperateforprofit.Cashandin-kindcontributions, 

reimbursements,andreasonablecompensationprovidedbymemberstowards 

thecollective'sactualexpensesofthegrowth,cultivation,andprovisionof 

medicalmarijuanashallbeallowedprovidedthattheyareinstrictcompliance 

withStateLaw.Allsuchcashandin-kindamountsanditemsshallbefully 

documentedinaccordancewithSection45.19.6.4ofthisarticle; 

7.Nopersonsundertheageofeighteenshallbeallowedatthelocation, 

unlessthatminorisaqualifiedpatientorpersonwithanidentificationcardand

accompaniedbyhisorherlicensedattendingphysician,parentordocumented 

legalguardian; 

8.Nocollectiveshallpossessmoredriedmarijuanaorplantspermember 

otherthantheamountspermittedpursuanttoStateLaw.Nocollectiveshall 

possessorprovidemarijuanaotherthanmarijuanathatwascultivatedbythe 

collectiveinstrictaccordancewithStateLawandthisarticle; 

9.ThelightfixturesrequiredinSection45.19.6.3A.3,above,shallbe 

turnedonfromdusktodawn; 

10.Nocollectivemayprovidemedicalmarijuanatoanypersonsother 

thanitsmemberswhoparticipateinthecollectivecultivationofmarijuanaator 

uponthelocationofthatcollective.Nomedicalmarijuanaprovidedtoaprimary 

caregivermaybesuppliedtoanyperson(s)otherthantheprimarycaregiver's 

qualifiedpatient(s)orperson(s)withanidentificationcard; 

11.Nocollectiveshallcauseorpermitthesale,dispensing,or 

consumptionofalcoholicbeveragesatthelocationorintheparkingareaof 

thelocation; 

12.Nodriedmedicalmarijuanashallbestoredinbuildingsthatarenot 

completelyenclosed,orstoredinanunlockedvaultorsafe,orotherunsecured 

storagestructure;norshallanydriedmedicalmarijuanabestoredinasafeor 

vaultthatisnotboltedtothefloororstructureofthefacility; 

13.Medicalmarijuanamaynotbeinhaled,smoked,eaten,ingested,or 

otherwiseconsumedatthelocation,intheparkingareasofthelocation,orin 

thoseareasrestrictedundertheprovisionsofCaliforniaHealthandSafetyCode 

Section11362.79.Thisprohibitionshallnotapplytoaqualifiedpatient'suseof 

marijuanaforhisorherownmedicalneedsifthequalifiedpatient'spermanent 

legalresidenceisthelocation,norshallthisprohibitionlimittheexceptions 

providedinlocalandstatelawthatpermitsmokingindesignatedareaswithin 

licensedresidentialmedicalandeldercarefacilities; 

14.Onlymembersofthecollectivemaybeengagedinthemanagement 

ofthecollective.Apersonwhohasbeenconvictedcurrentlyorwithinthe 

previous10yearsofafelonyoracrimeofmoralturpitude,orwhoiscurrentlyon 

paroleorprobationforthesaleordistributionofacontrolledsubstance,as 

determinedbythePoliceDepartment,shallnotbeengageddirectlyorindirectly 

inthemanagementofthecollectiveand,further,shallnotmanage,handle,or 

benefitfromthereceiptsandexpensesofthecollective.Verificationshallbe 

processedandreceivedbythePoliceDepartmentinaccordancewiththeState 

ofCaliforniaDepartmentofJusticeguidelines.Nopersonmaybeengagedin 

themanagementofmorethanonecollectivelocatedwithintheCity;

15.Noqualifiedpatient,personwithanidentificationcard,orprimary 

caregivermaybeamember,atthesametime,ofmorethanonecollective 

locatedwithintheCity,exceptthatintheeventofamedicalemergency,a 

qualifiedpatient,personwithanidentificationcard,orprimarycaregivermay 

obtainmedicalmarijuanasufficienttomeetthatmedicalemergencyfromanother 

collectivelocatedwithintheCity.Inadditiontoallotherrequireddocumentation, 

foramedicalemergency,thequalifiedpatient,personwithanidentificationcard, 

orprimarycaregivershallprovidewrittenproofofthemedicalemergencyand,as 

applicable,hisorherattendingphysicianordoctorrecommendation, 

identificationcard,and,inthecaseofaprimarycaregiver,thepatientdesignation 

toboththemember'scollectiveandtothecollectivethatisdistributingthe 

emergencymedicalmarijuana.Thiswrittendocumentationshallbemaintained 

intherecordsofbothcollectives; 

16.Collectivesshallnotstoremorethan$200.00incashovernightatthe 

locationandshallmaketwicedailybankdropsthatincludeallcashcollectedon 

thatday; 

17.Collectivesshallprovideastate-licensedanduniformedsecurity 

guardpatrolforatwo-blockradiussurroundingthelocationduringallhoursof 

operation.Securityguardsshallnotpossessfirearmsortasers; 

18.Collectivesshalloperateandmaintainanonsite24-hourtelephone 

numberatthecollectiveforreceivingcomplaintsandotherinquiriesregarding 

thecollective.Amemberengagedinthemanagementofthecollectiveshallbe 

responsibleforreceiving,logging,andrespondingtothesecomplaintsandother 

inquires.Thelogshallbemaintainedintherecordsofthecollective;and 

19.TheresultsofthetestingperformedpursuanttoSection45.19.6.5of 

thisarticleshallbepostedinaprominentlocationintheinteriorofthecollective. 

SEC.45.19.6.4.MAINTENANCE OF RECORDS. 

Amedicalmarijuanacollectiveshallmaintainrecordsatthelocationaccurately 

andtruthfullydocumenting:(1)thefullname,address,andtelephonenumber(s)ofthe 

owner,landlordand/orlesseeofthelocation;(2)thefullname,address,andtelephone 

number(s)ofallmemberswhoareengagedinthemanagementofthecollectiveand 

theexactnatureofeachmember'sparticipationinthemanagementofthecollective;(3) 

thefullname,address,andtelephonenumber(s)ofallpatientmemberstowhomthe 

collectiveprovidesmedicalmarijuana,acopyofagovernment-issuedidentificationcard 

forallpatientmembers,andacopyofeveryattendingphysician'sordoctor's 

recommendationorpatientidentificationcard;(4)thefullname,address,andtelephone 

number(s)ofallprimarycaregivermemberstowhomthecollectiveprovidesmedical 

marijuanaandacopyofeverywrittendesignation(s)bytheprimarycaregiver'squalified 

patient(s)ortheprimarycaregiver'sidentificationcard;(5)writtendocumentationofall 

circumstancesunderwhichthecollectiveprovidedmedicalmarijuanatoanon-member, 

includingbutnotlimitedtotherecipient'sfullname,address,andtelephonenumber,

amountofmedicalmarijuanareceived,andmedicalemergencyjustification;(6)all 

receiptsofthecollective,includingbutnotlimitedtoallcontributions,reimbursements, 

andreasonablecompensation,whetherincashorinkind,andallexpendituresincurred 

bythecollectiveforthecultivationofmedicalmarijuana;(7)aninventoryrecord 

documentingthedates,amounts,andcontenttestingresultsofallmarijuanacultivated 

bythecollective,includingtheamountsofmarijuanastoredatthelocationatanygiven 

time;(8)alogdocumentingeachtransferofmarijuanareflectingtheamount 

transferred,thedatetransferred,andthefullnameofthemembertowhomitwas 

transferred;(9)alogdocumentingthedate,nature,andresponsebythecollectivetoall 

complaintsreceivedbythecollectivepursuanttoSection45.19.6.3B.18ofthisarticle; 

(10)acopyoftheannualauditreportsrequiredpursuanttoSection45.19.6.5Aofthis 

article;(11)thetestinglogrequiredtobemaintainedpursuanttoSection45.19.6.5Cof 

thisarticle;and(12)proofofregistrationwiththeDepartmentofBuildingandSafetyin 

conformancewithSection45.19.6.2ofthisarticle,includingevidenceofanaccepted 

registrationform.Theserecordsshallbemaintainedbythecollectiveforaperiodof 

fiveyearsandshallbemadeavailablebythecollectivetothePoliceDepartmentupon 

request,exceptthatprivatemedicalrecordsshallbemadeavailablebythecollectiveto 

thePoliceDepartmentonlypursuanttoaproperlyexecutedsearchwarrant,subpoena, 

orcourtorder.Inadditiontoallotherformatsthatthecollectivemaymaintain,these 

recordsshallbestoredbythecollectiveatthelocationinaprintedformatinitsfire-proof 

safe.Anyloss,damageordestructionoftherecordsshallbereportedtothePolice 

Departmentwithin24hoursoftheloss,destructionordamage.Inadditiontoallother 

formatsthatthecollectivemaymaintain,theserecordsshallbestoredbythecollective 

atthelocationinaprintedformatinitsfire-proofsafe.Anyloss,damageordestruction 

oftherecordsshallbereportedtothePoliceDepartmentwithin24hoursoftheloss, 

destructionordamage. 

SEC. 45.19.6.5. AUDITSANDTESTING. 

A.AnnualAudits.NolaterthanFebruary15ofeveryyear,eachcollective 

shallfilewiththeCityControlleranauditofitsoperationsofthepreviouscalendaryear, 

completedandcertifiedbyanindependentcertifiedpublicaccountantinaccordance 

withgenerallyacceptedauditingandaccountingprinciples.Theauditshallincludebut 

notbelimitedtoadiscussion,analysis,andverificationofeachoftherecordsrequired 

tobemaintainedpursuanttoSection45.19.6.4ofthisarticle. 

B. Testing of MedicalMarijuana.Thecollectiveshalluseanindependentand 

certifiedlaboratorytoanalyzearepresentativesampleofdriedmedicalmarijuanaanda 

representativesampleofediblemarijuanaforpesticidesandanyotherregulated 

contaminantspursuanttoestablishedlocal,state,orfederalregulatoryorstatutory 

standardsatlevelsofsensitivityestablishedforthefoodanddrugsupplybefore 

providingthemedicalmarijuanatoitsmembers.Anymedicalmarijuanafromwhichthe 

representativesampleanalysistestedpositiveforapesticideorothercontaminantata 

levelwhichexceedsthelocal,state,orfederalregulatoryorstatutorystandardforthe 

foodanddrugsupplyshallnotbeprovidedtomembersandshallbedestroyed 

forthwith.Anymedicalmarijuanaprovidedtomembersshallbeproperlylabeledinstrict 

compliancewithstateandlocallaws.

C. Testing Log. Thecollectiveshallmaintainawrittenlogatthelocation 

documentingthedate,type,andamountofmarijuanatested;thenameofthelaboratory 

wherethemarijuanawastested;thelaboratoryreportcontainingtheresultsofthe 

testing,includingthenameandlevelofthesubstancedetected;andthedispositionof 

themarijuanafromwhichthecontaminatedsamplewasobtained,includingtheamount 

ofmarijuanaandthedateandmannerofdisposition. 

SEC. 45.19.6.6. INSPECTION AND ENFORCEMENT RESPONSIBILITIES.  

TheDepartmentofBuildingandSafetymayenterandinspectthelocationofany 

collectivebetweenthehoursof10:00a.m.and8:00p.m.,oratanyreasonabletime,to 

ensurecompliancewithSection45.19.6.3Aofthisarticle.Inaddition,adeslqnatedunit 

withinthePoliceDepartmentmayenterandinspectthelocationofanycollectiveand 

therecordingsandrecordsmaintainedpursuanttoSections45.19.6.3,45.19.6.4,and 

45.19.6.5ofthisarticlebetweenthehoursof10:00a.m.and8:00p.m.,oratany 

reasonabletime,toensurecompliancewiththisarticle,exceptthattheinspectionand 

copyingofprivatemedicalrecordsshallbemadeavailabletothePoliceDepartment 

onlypursuanttoaproperlyexecutedsearchwarrant,subpoena,orcourtorder.Itis 

unlawfulforanyowner,landlord,lessee,member(includingbutnotlimitedtoamember 

engagedinthemanagement),oranyotherpersonhavinganyresponsibilityoverthe 

operationofthecollectivetorefusetoallow,impede,obstructorinterferewithan 

inspection,revieworcopyingofrecordsandclosed-circuitmonitoringauthorizedand 

requiredunderthisarticle,includingbutnotlimitedto,theconcealment,destruction,and 

falsificationofanyrecordings,records,ormonitoring. 

SEC. 45.19.6.7. EXISTING MEDICAL MARIJUANA OPERATIONS.  

Any existingmedicalmarijuanacollective,dispensary,operator,establishment, 

orproviderthatdoesnotcomplywiththerequirementsofthisarticlemustimmediately 

ceaseoperationuntilsuchtime,ifany,whenitcompliesfullywiththerequirementsof 

thisarticle;exceptthatanymedicalmarijuanacollective,dispensary,operator, 

establishment,orproviderthatmeetseachoftherequirementsdescribedinSection 

45.19.6.2B.2ofthisarticleshallhave180daysfromtheeffectivedateofthisarticle 

duringwhichtofullycomplywiththerequirementsofthisarticleortoceaseoperation. 

Nomedicalmarijuanacollective,dispensary,operator,establishment,orproviderthat 

existedpriortotheenactmentofthisarticleshallbedeemedtobealegallyestablished 

useundertheprovisionsofthisarticle,andsuchmedicalmarijuanacollective, 

dispensary,operator,establishment,orprovidershallnotbeentitledtoclaimlegal 

nonconformingstatus. 

SEC. 45.19.6.8 COMPLIANCE WITH THIS ARTICLE AND STATE LAW.  

A. Itisunlawfulforanypersontocause,permitorengageinthecultivation, 

possession,distributionorgivingawayofmarijuanaformedicalpurposesexceptas 

providedinthisarticle,andpursuanttoanyandallotherapplicablelocalandstatelaws.

B.Itisunlawfulforanypersontocause,permitorengageinanyactivityrelated 

tomedicalmarijuanaexceptasprovidedinHealthandSafetyCodeSections11362.5 et  

seq., andpursuanttoanyandallotherapplicablelocalandstatelaws. 

C.Itisunlawfulforanypersontoknowinglymakeanyfalse,misleadingor 

inaccuratestatementsorrepresentationsinanyforms,records,filingsordocumentation 

requiredtobemaintained,filedorprovidedtotheCityunderthisarticle,ortoanyother 

local,stateorfederalgovernmentagencyhavingjurisdictionoveranyoftheactivitiesof 

collectives. 

D.Itshallbethesoleresponsibilityofthemembersengagedinthemanagement 

ofthecollectivetoensurethatthecollectiveisatalltimesoperatinginamanner 

compliantwithallapplicablestatelawsandthisarticle.Nothinginthisarticleshallbe 

construedasauthorizinganyactionswhichviolatestatelawwithregardtothe 

cultivation,transportation,provision,andsaleofmedicalmarijuana. 

SEC.45.19.6.9.VIOLATIONANDENFORCEMENT. 

Eachandeveryviolationofthisarticleshallconstituteaseparateviolationand 

shallbesubjecttoallremediesandenforcementmeasuresauthorizedbySection11.00 

ofthisCode.Additionally,asanuisanceperse,anyviolationofthisarticleshallbe 

subjecttoinjunctiverelief,revocationofthecollective'sregistration,revocationofthe 

certificateofoccupancyforthelocation,disgorgementandpaymenttotheCityofany 

andallmoniesunlawfullyobtained,costsofabatement,costsofinvestigation,attorney 

fees,andanyotherrelieforremedyavailableatlaworequity.TheCitymayalso 

pursueanyandallremediesandactionsavailableandapplicableunderlocalandstate 

lawsforanyviolationscommittedbythecollectiveandpersonsrelatedorassociated 

withthecollective. 

Notwithstandinganinitialverificationofcompliancebythecollectivewiththe

SEC.45.19.6.10.SUNSETCLAUSE. 

Theprovisionsofthisarticleshallsunsettwoyearsaftertheeffectivedateofthis 

ordinanceandallcollectivesshallceaseoperationimmediately,unlesstheCityCouncil 

adoptsanordinancetoextendtheseprovisions. 

Sec.2.Section91.107.3.2oftheLosAngelesMunicipalCodeisamendedby 

addinganewitem5toread: 

5.MedicalMarijuanaCollectivePreinspection.Apreinspectionfee 

pursuanttoSection45.19.6.2DoftheLosAngelesMunicipalCodeshallbe

collectedbytheDepartmenttoverifycompliancewithSection49.19.6.3Aofthe 

LosAngelesMunicipalCode.Thepreinspectionfeeshallbeinadditiontoany 

otherfeethattheDepartmentdeterminesisnecessaryduetothenatureofthe 

workinvolved. 

Sec.3. Operative Date.  

Thisordinanceshallnotbecomeeffectiveuntiltheregistrationfeespecifiedin 

Section1ofthisordinancebecomeseffective. 

Sec.4. Severability. PursuanttotheprovisionsofLosAngelesMunicipalCode 

Section11.00(k),ifanyprovisionofthisordinanceisfoundtobeunconstitutionalor 

otherwiseinvalidbyanycourtofcompetentjurisdiction,thatinvalidityshallnotaffectthe 

remainingprovisionsofthisordinancewhichcanbeimplementedwithouttheinvalid 

provision,and,tothisend,theprovisionsofthisordinancearedeclaredtobeseverable.

Sec.5TheCityClerkshallcertifytothepassageofthisordinanceandhaveit 

publishedinaccordancewithCouncilpolicy,eitherinadailynewspapercirculated 

intheCityofLosAngelesorbypostingfortendaysinthreepublicplacesintheCityof 

LosAngeles:onecopyonthebulletinboardlocatedattheMainStreetentrancetothe 

LosAngelesCityHall;onecopyonthebulletinboardlocatedattheMainStreet 

entrancetotheLosAngelesCityHallEast;andonecopyonthebulletinboardlocated 

attheTempleStreetentrancetotheLosAngelesCountyHallofRecords.
